This Publicity Waiver and Release (“Agreement”) is entered into between FN Magazine LLC d/b/a Fat Nugs Magazine, a Georgia limited liability company (“FNM”), and the participating company or brand listed below (together, “Companies”), and the individual named and identified below (“I” or “me”). By signing this Agreement, I grant the Companies full permission to use my name, image, likeness, voice, and personal or biographical information (“Materials”) for any lawful business, advertising, or promotional purpose connected to the Faces of Cannabis project or any other related FNM programs. This includes, without limitation, use in print, online, video, broadcast, social media, and all other media formats now known or later developed, worldwide, in perpetuity.I understand and agree that:I will not receive payment, royalties, or further approval rights for the use of the Materials.The Companies are the exclusive owners of all rights to the Materials and may edit, adapt, reproduce, publish, or distribute them at their sole discretion.I release and hold harmless the Companies, their officers, employees, affiliates, agents, licensees, contractors, and partners (“Authorized Persons”) from any and all claims or liability arising from the creation, use, or publication of the Materials, including but not limited to claims of defamation, invasion of privacy, or violation of publicity rights.I agree not to bring any claim or legal action against the Companies or Authorized Persons related to this release or the use of the Materials.I represent that I am at least 21 years of age, have full authority to grant these rights, and that my participation does not violate the rights of any third party.If I consume any controlled substance during a photo or video session, I do so voluntarily and at my own risk. I understand that the Companies do not encourage or condone such use and assume no responsibility for any effects, injury, or legal consequences related to it. I release and discharge the Companies and all Authorized Persons from any and all claims or damages arising from such conduct.I also consent to receive commercial or promotional communications from the Companies (including email or mobile notifications) in accordance with their privacy policy, with the option to unsubscribe at any time.This Agreement is binding upon me and my heirs, executors, and assigns and benefits the Companies and their successors and assigns. It represents the full and final understanding between us regarding this subject and supersedes any prior agreements or discussions.All matters arising under this Agreement shall be governed by the laws of the State of California, and any disputes shall be resolved exclusively in the state or federal courts located in California.BY SIGNING BELOW, I acknowledge that I have read, understand, and voluntarily agree to all the terms of this Agreement, and that I am giving up substantial legal rights, including the right to sue the Companies or Authorized Persons for any reason connected to the use of my name, likeness, or participation.
